Khaled Moyeed Secures High Court Victory for Dubai-Based Clients in Complex Cross-Border Dispute

Khaled Moyeed, working alongside barrister, Katie Longstaff of Radcliffe Chambers and trainee solicitor, Su Ozkan, has successfully secured the discharge of a worldwide freezing injunction and a proprietary injunction in the High Court of Justice in London. The injunctions had been granted against his Dubai-based clients at a ‘without notice’ hearing, imposing severe restrictions on their assets before they had an opportunity to respond.

The case stemmed from a high-value, multi-jurisdictional dispute involving a £30 million property-backed loan transaction. The complex structure of the deal—spanning corporate entities in Dubai, the British Virgin Islands, Liechtenstein, and England, with London properties held through offshore vehicles—presented significant jurisdictional challenges for the English courts.

At the return date hearing, Khaled and his team demonstrated that the Applicant had failed to meet the critical obligation of full and frank disclosure—a fundamental requirement in ‘without notice’ applications. The evidence presented was found to be misleading, particularly regarding the alleged risk of dissipation and the urgency of the injunction. Additionally, key issues, such as the true identity of the parties and the ownership structure of the assets, had not been properly disclosed to the court.

Khaled’s clients also contested the jurisdiction of the English courts, given their Dubai-based operations and the offshore nature of the entities involved. Further, the Applicant’s cross-undertaking in damages—intended to protect respondents if an injunction is wrongly granted—was legally and practically inadequate, relying on a jointly held personal bank account of questionable reliability.

Within just three weeks of proceedings being issued, Khaled successfully secured the discharge of the freezing injunctions and negotiated a favourable commercial settlement of the Applicant’s underlying claim, bringing the entire dispute to a swift resolution.
