Experience Highlights

Union Music Ltd v Russell Watson

  • Harvey was instructed by Union Music in a claim against the Opera singer Russell Watson in relation to his Management Agreement. He successfully defended an appeal to the Court of Appeal of a decision to refuse Mr Watson’s application to strike out the case against him on an argument of a Contract being voidable.
  • Again Harvey was instructed by Union Music in a successful appeal to the Court of Appeal in relation to the power of a Court’s Order in an Extra Ordinary General Meeting of Shareholders to consider a resolution where the majority of the Board were opposed to such a meeting and resolution.

Cream Holdings v Banerjee and Trinity Mirror Group

  • Harvey represented Cream Holdings in obtaining an Injunction against Trinity Mirror Group to prevent the publication of time sensitive commercial information and thereafter represented the company in appeals to both the Court of Appeal and the House of Lords.

M-TECH Data Systems Limited v Sun Microsystems Inc

  • Harvey represented M-TECH in their defence of a claim for Trademark infringement where the Court considered new Defences to a Trademark claim in both the Court of Appeal and the Supreme Court.

Harry Wiltshire v British Triathlon Federation

  • Harvey represented Harry Wiltshire in his international appeal to the Court of Arbitration for Sport of his ban from international competition based upon the interpretation of the International Triathlon Union Regulations.
