  • Goldspan Limited [In Liquidation] -v- A.J Patel [2012] EWHC (CD). The liquidator unsuccessfully alleged that the defendant was involved in the sale at an under value of company property and the laundering of the proceeds. Timothy successfully defended the claim, discharged a worldwide injunction and obtained an order for costs.
  • Ortega Associates Limited [In Liquidation] -v- Peter Walkling [2007] EWHC (CD). The liquidator unsuccessfully claimed breach of trust against a former director. Timothy successfully defended the claim which also dealt with complex issues involving money laundering issues.
  • Rees -v- Skerrit & Others [2002] EWCA. CIV 760 Court of Appeal. Timothy successfully claimed that the Claimant’s terraced property was entitled to support by a neighbouring property after the neighbour demolished his end of terrace residential property.
  • Dadu’s Limited -v- Barrowfen properties Limited [2008] Bromley County Court. Timothy successfully defended a claim for possession made by the commercial landlord under S30(1)(f) Pt II Landlord & Tenant Act 1954 where the landlord opposed the grant of a new lease on the ground that it wanted to develop the premises.
  • McCabe -v- Cornwall County Council [2004] UKHL 15 July 2004.in which the House of Lords opened the door to a potential claim for loss as a result of the manner of a dismissal in relation to unfair dismissal claims.
  • Habibsons Bank Limited – v – Standard Chartered Bank PLC [2010] EWCA 1335 a claim during the financial crash in 2008 under the Loan Market Association regulations where it was unsuccessfully argued before the Court of Appeal that an alteration of a LMA Trade by use of tipex did not vitiate the contract. The loss caused to the Claimant was recovered via the Netherlands Central Bank Emergency regulations.
