Final call for Spanish citizenship applications under the Democratic Memory law 

Following gunnercooke Partner Claudia Font´s first article on this topic, followed by a legal update, this is the final call for citizens eligible to apply for Spanish nationality and passport:  

As of April 20, 2025, only six months remain before the Democratic Memory Law (Law 20/2022) reaches its deadline on October 20, 2025. This law grants eligible individuals the opportunity to apply for Spanish citizenship, and therefore, to get a European passport, based on family ties. If you or a family member qualify but have not yet submitted an application, now is the time to act.  

Who is eligible?  

The law allows children and grandchildren born outside of Spain whose parents were originally Spanish citizens.   

 Why apply now?  

As things are at present, and unless in the following months Spanish authorities say otherwise, applications can be submitted until October 20, 2025.  

With a high volume of applications and potential administrative delays, waiting until the last minute could result in complications. Also, gathering the necessary documents normally takes a couple of months, thus by applying now, you can avoid unnecessary stress and ensure a smoother process.  

What happens after the law expires?  

Making it very simple: still chances to apply, but the requirement to renounce to British citizenship will apply again to those born before 1978 from a Spanish mother, or to grandchildren whose parents applied after the birth of their descendants.  

This makes applying under the Democratic Memory Law a major advantage, as it allows for nationality acquisition without the need for renunciation.
