Organic Law 1/2025, of 2 January, on measures to improve the efficiency of the Public Justice Service, has introduced significant changes to Spanish regulations, notably the elimination of the so-called “golden visa.” These visas allowed non-EU citizens to obtain residency permits through substantial investments in the country, particularly in the real estate sector.

The “golden visa” was introduced to support entrepreneurs and foreign investments, and it consisted in granting residence visas to non-EU citizens who made significant investments, such as acquiring real estate worth a minimum of €500,000, investing in public debt, or funding business projects of general interest.

However, with the implementation of Organic Law 1/2025, the provisions regulating these type visas have been cancelled and no longer will have legal effect. This measure responds to concerns about the impact of the “golden visa” on the real estate market, particularly in urban and tourist areas, where it has driven up housing prices, making it harder for local residents to access affordable homes.

A Narrow Window of Opportunity

For those still interested in applying, the clock is ticking: 3rd April 2025 is the deadline for submitting applications under the existing regulations. Investors who successfully obtain a Golden visa before this date will still be able to retain and renew it under the previous framework, making this a unique opportunity to secure long-term residency rights in Spain.

A Broader European Trend

With this recent change in law, Spain joins a growing list of countries that have ended or reformed similar visa initiatives or programs, including Ireland, Portugal, Cyprus, Malta and Greece

Act Now or Miss Out

The elimination of the “golden visa” in Spain is part of a wider movement across Europe, driven by concerns about housing affordability and market speculation. While the decision aims to protect local communities, it also marks the end of an era for foreign investors seeking an attractive pathway to residency in Spain.

For those considering the “golden visa,” the coming months represent the last opportunity to take advantage of the current laws before their advantages are removed.
