gunnercooke Dispute Resolution and Charity Partner Khaled Moyeed represented a group of charity trustees who were ousted from the day to day running of a charity following a dispute between trustees.

The matter was referred to Khaled after his clients tried unsuccessfully to secure an injunction allowing them to go back to the management of the charity. Although the injunction was rejected on a technicality, Khaled’s clients were somewhat on the backfoot.

He made representations to the Charity Commission on behalf of his clients who recommended that mediation is used in the first instance to attempt to resolve the dispute between the parties.

The parties appointed Mr Rahim Shamji, CEO of ADR ODR International to act as the mediator. At a mediation meeting, Khaled made submissions on behalf of his clients assisted to reach a settlement agreement with the other side.

Khaled regularly advises a growing list of charity clients who are faced with complex disputes or the subject of regulatory investigations by the Charity Commission. He is currently representing the former chair of a charity in High Court proceedings.

Khaled said, “Charity disputes between trustees about how a charity should be managed are more common than one would think. However, they need to handle sensitively and carefully as different rules apply when bringing charity proceedings, a permission of the Charity Commission is a pre-requisite. The Charity Commission is also reluctant to give permission unless the parties have exhausted ADR which often means mediation. I have now assisted several clients in successful mediation. I also regularly advise charity clients facing statutory enquiries or other investigations by the Charity Commission”.
