gunnercooke wins UK Impact Case of the Year at Managing IP EMEA Awards

gunnercooke Intellectual Property Partner, Rachel Pearse, has been awarded UK Impact Case of the Year at the 20th annual Managing IP Awards, for her work on the landmark WaterRower (UK) v Liking (2024) case.

The Managing IP Awards brings together top firms and professionals from across Europe, the Middle East, and Africa to celebrate outstanding achievements in IP law. This year’s ceremony saw over 650 leaders from the industry gather for an evening of recognition and networking on 10th April. 

The WaterRower (UK) v Liking (2024) case was a landmark matter in intellectual property law. The case set a significant precedent that impacts the future of IP law. Rachel’s strategic approach and deep expertise played an instrumental role in navigating the legal complexities and securing a favourable outcome for the client.

WaterRower UK Limited claimed copyright protection for its water resistance rowing machines as works of artistic craftsmanship under UK law and accused Liking Limited of copying them in its TOPIOM WaterRowers. Liking, represented by gunnercooke, argued that no copyright subsisted in the WaterRower, highlighting a legal conflict between UK and EU law. The UK’s Hensher decision requires artistic merit, while EU case law (Cofemel and Brompton) does not.

Reflecting on the win, Rachel Pearse added: “I’m honoured that our firm has received this recognition for our hard work on this case, for which we waited just over a year for final judgment. IP law is constantly evolving, and it has been incredibly rewarding to work on this case.”

In addition to winning the UK Impact Case of the Year, gunnercooke were also shortlisted for IPEC Firm of the Year, recognised for its work on leading IP, copyright and patent cases in the UK and globally.
