Gunnercooke Dispute Resolution Partner, Khaled Moyeed successfully obtained permission to appeal against a lower court judgment in the High Court on 18 January 2023.
The client instructed Khaled as the judgment involved issues around arbitration and the applicability of the Arbitration Act 1996. The lower court judge had referred to the existence of an arbitration agreement as a matter of semantics rather than whether such an agreement existed.
Khaled successfully argued before the High Court that this was the wrong approach on the question of arbitration. The High Court judge also gave permission on two other grounds. The matter will now be listed for a full appeal hearing.
Khaled Moyeed joined gunnercooke in July 2022 bringing with him significant arbitration and litigation experience. He has 15 years’ experience as a lawyer including two years working with an international law firm in Dubai. His practice spans all areas of dispute resolution including international arbitration, mediation, property disputes and reputation management.
