Rohit has over 40 years of experience in commercial litigation and commercial and intellectual property. His clients often face complex and involved legal problems, which require careful thought and step-by-step analysis. He has established a long and varied record of finding novel solutions to exceptional legal challenges, at the frontiers of the law, and in developing persuasive arguments for the benefit of his clients. His work has resulted in leading judgments in patents and trademarks litigation and the regulation and free movement of medicinal products, as well as uniformly successful outcomes in taxation disputes and professional negligence. He has delivered lectures at a number of leading British universities, in connection with his work and the critical analysis of the law and principles of public importance.

A significant part of Rohit’s work is and has throughout his career been conducted on a pro bono basis.

Pharmaceutical law and regulation

Rohit’s pharmaceutical clients range from pharmaceutical wholesalers to retail chain operators as well as individual traders.

His team routinely advises clients in relation to:

  • the sale and purchase of pharmacies
  • pharmacy premises within medical surgeries
  • pharmacy management agreements
  • the sale, purchase and distribution of medicines
  • regulatory law relating to the pharmacy and the pharmacist
  • regulatory consents
  • relocation

Rohit also routinely deals with issues raised by regulators such as:

  • the Medicines and Healthcare Products Regulatory Agency
  • the European Medicines Agency
  • the Competition and Markets Authority
  • the General Pharmaceutical Council

An unfavourable decision of a regulator can lead to enormous financial loss. It therefore sometimes becomes necessary to challenge a regulator’s decision. In such a case, Rohit will seek a review by the courts of the decision in question.

Intellectual property litigation

In a fast-moving world, a pharmaceutical or apparel wholesaler or distributor may find itself caught up in a dispute relating to trademarks and patents.

For more than 30 years, Rohit worked tirelessly to protect clients from allegations of trademark or patent infringement.

He routinely represents clients involved in disputes relating to:

  • Trademark and patent
  • The importation and distribution of branded and generic pharmaceutical products
  • The manufacture and distribution of branded apparel and footwear
  • Payments and disputes relating to royalties
  • Judicial reviews of regulatory decisions of the government and of administrative bodies adversely affecting clients
  • The law relating to the movement of goods within the European Union

Rohit advises affected clients in relation to new trade arrangements which may affect their businesses following Brexit, and in relation to their new regulatory obligations.

Rohit’s history establishes his practice as one of the country’s leading defendant’s practices in the trade and movement of pharmaceutical products, and their regulation.

He has litigated a number of significant cases which have contributed to a better understanding of the case law of the European Court of Justice.

What started as disputes relating to trademarks or patents sometimes ended up involving a review by the courts of the regulator’s decision. Those battles therefore blurred the distinction between private law and public law.

Dispute resolution and general litigation

For over 30 years, Rohit has litigated disputes in the County Courts, the High Court, the Court of Appeal and the European Court of Justice.  His various teams have also represented clients before specialist tribunals and disciplinary bodies of professional organisations.

These include:

  • commercial disputes involving multi-jurisdictional parties
  • tax disputes before the First Tier Tax Tribunal and on appeal
  • landlord and tenant disputes
  • property disputes
  • shareholder, partnership and company disputes
  • professional negligence and professional misconduct allegations

At an early stage, Rohit’s team will assess the commercial justification for litigating the challenge. First, it will consider the evidence carefully. Second, we will seek to minimise a client’s costs by attempting to mediate a settlement.  Next, his team of lawyers will give the client clear guidance, at the outset, and at each stage of negotiation, on the options available. Finally, it will try to maximise the client’s prospect of an early settlement.

If, however, litigation is inevitable, clients will be offered the most able, cost-effective, service. Rohit will litigate your case with your opponents efficiently, courteously, firmly and calmly.
